First, thoughts and prayers to all of the injured and killed in Paris on Friday.
Somewhat ironically, as this series of horrible events was transpiring, I was putting the finishing touches on a paper explaining precisely why it is that I don’t find even remotely plausible the argument that ISIS or its ilk impose “strict” or “literal” classical Islamic law, even if classical Islamic law did not rest upon presumed principles of mutual self recognition and respect for the territorial integrity of non-Muslim states. The article focuses most prominently on lone wolf terrorism, which clearly is not what transpired in France, but nonetheless some of its themes reverberate enough that I thought it was worth inserting into the conversation. I’ve posted it on SSRN, and it should be out relatively soon with the FIU Law Review.
